Canada - Voluntary Code & ADM Directive

Canada's proposed AI-specific law, AIDA, did not proceed after Parliament was prorogued in January 2025. In its place, the federal Voluntary Code of Conduct for Generative AI and the binding Directive on Automated Decision-Making for federal institutions are the current practical reference points, alongside PIPEDA and provincial privacy law.

Who it applies to

  • Signatories to the Voluntary Code of Conduct for Generative AI
  • Federal institutions subject to the Directive on ADM
  • Organisations aligning to PIPEDA and provincial privacy laws

Core obligations

  • Adopt Voluntary Code principles for advanced generative systems
  • Complete Algorithmic Impact Assessments for federal ADM
  • Provide notice, explanation and recourse to affected individuals
  • Maintain human oversight proportionate to impact level
